Who provides Chip Stack
Chip Stack is provided by AppManufaktur, Inh. André Jaszka, Rebhuhnweg 12, 59227 Ahlen-Vorhelm, Germany, email: info@jaszka.com.
What Chip Stack is for
With Chip Stack, a private poker round organises its dates, who hosts next, substitute hosts and its history.
Chip Stack is not a gambling service: no games are played in the app, and there are no stakes, no winnings and no payments in the app. How you run your round at the table is entirely up to you.
Price and conclusion of contract
Chip Stack costs a one-time €0.99 or the equivalent amount shown in the respective country. You buy the app in Apple’s App Store or on Google Play under the terms shown there; the purchase contract is concluded there. Payment, withdrawal and refunds are handled by the respective store under its rules; your statutory rights remain unaffected. Every member of a round needs the app on their own device. There are no further purchases and no subscription in the app.
If you download Chip Stack from the App Store, Apple’s standard licence agreement (Licensed Application End User License Agreement) also applies to the app. Where it deviates from these terms, these terms take precedence.
Access
There is no account. Whoever creates a round is its creator and can invite others with an invitation code. Access to a round is tied to the respective device. The creator should keep the recovery code received when creating the round in a safe place; without it, the creator access cannot be restored after changing devices.
Rules
- Only enter your own name, for example your first name or a nickname by which the round knows you.
- Only pass the invitation code on to people who actually play along.
- Names of rounds, names and locations must not insult anyone or infringe the rights of others.
- Do not try to guess other people’s codes, overload the service or access rounds you have not been invited to.
Anyone who breaks these rules can be removed from the round by the creator.
Availability
Chip Stack runs on a private server at my home. Short interruptions due to maintenance, power or internet outages are possible. I continue to develop Chip Stack and only change it for a valid reason, for example for security or technical adjustments, at no additional cost to you and in such a way that dates, host rotation and history are preserved. I will inform you in advance of changes that affect you more than insignificantly; you then have the statutory rights under Section 327r of the German Civil Code (BGB). I will not discontinue the service without good cause and will announce any discontinuation at least three months in advance on this website. Your statutory rights, including in the event of defects, remain unaffected.
Liability
I am liable without limitation for intent and gross negligence, for damage resulting from injury to life, body or health, and under the German Product Liability Act (Produkthaftungsgesetz).
In the case of slight negligence, I am only liable if I breach an essential contractual obligation, that is, an obligation whose fulfilment makes the use of Chip Stack possible in the first place and on whose observance you may regularly rely. In this case, liability is limited to the foreseeable damage typical for this type of contract. Otherwise, liability for slight negligence is excluded.
Ending use
You can stop using Chip Stack at any time. How to leave a round and delete your data is described in the Privacy Policy.
Changes to these terms
If these terms change, the new version with a new “last updated” date is published on this page. Anyone who creates or joins a round confirms the version current at that time.
Applicable law
German law applies. Mandatory consumer protection provisions of the country where you live remain unaffected.
